The Articles of Impeachment of President Donald J. Trump Should Use Minnesota to Describe the Entire Scope of his Anti-Constitutional Scheme

I am concerned and worried for the country and am trying to use my powers of discernment to see the scale of the scandal we are facing. I am not trying to lure you down any rabbit holes. You are free to be skeptical, doubtful, and to see things differently. I think we are facing a wide-ranging conspiracy. The next Articles of Impeachment of Donald J. Trump should not be a piecemeal effort. They should explain to the American people the full scope of this attack on the Constitution of the United States of America.


I. Planned Chaos: Minnesota Would Pay For Rejecting Trump Three Times with an Unconstitutional Invasion

On January 29, 2026, Minneapolis Mayor Jacob Frey addressed the United States Conference of Mayors. He was greeted warmly by his colleagues from around the country. Frey stressed that mayors are on the very front line of the threats to our democracy and civil society from Trump's administration. He said something very significant that we are losing in the fog of this conflict unfolding in the streets of his city. It is something that leads to the incontestable fact that Donald Trump has to be removed from this office by force. It should form the core of his articles of impeachment and provides a structure to organizing our thinking on it.

Frey said that Operation Metro Surge, the Trump administration's so-called efforts to surge ICE and CBP into communities under the ostensible claim of enforcing immigration laws, is directly connected to the President’s demand for the voter roll information from Minnesota. These voter roll requests have been made to "blue" states including Colorado, Oregon, Washington among others. Secretaries of State, the usual custodians of these records and administrators of elections, and Attorneys General, who enforce state voting laws, have pushed back very hard against the administration's demands. They know it is part of a plot to interfere with the administration of the 2026 midterms.

But let’s dwell on Mayor Frey’s point. The sitting President sicced a cobbled together personal army made up of federal armed officers from ICE CBP BOP HSI FPS DEA NPP onto a sovereign U.S. state to break its will into giving him voter data. He used officers under his direct authority and whose police power could not be impeded by normal checks and balances. Three thousand agents, mostly from ICE and CBP were deployed to the metropolitan Twin Cities, a place with six hundred regular police officers in its ranks. They operated under the command of the absurd CBP officer Greg Bovino, who more and more is clearly the inspiration for Steven Lockjaw of the Paul Thomas Anderson movie One Battle After Another.

These masked secret police agents were dispatched to physically attack U.S. citizens and residents of any legal immigration status. Almost literally the menacing mobster's famous line "Nice state, shame if anything happened to it" applies here. Outrage engulfed the nation as Operation Metro Surge devolved into total chaos after the murders of Reneé Nicole Good on January 7 and Alex Jeffrey Pretti on January 24 by agents of Trump's operation. The nation has reached a boiling point. Faced with a crisis of spiraling proportions, Trump retreated by dismissing Bovino and sending in Tom Homan. Homan is famous for being Trump's pugilistic "Border Czar." If a face could be a fist, it would be Tom Homan. He had disappeared from view at about the time unnamed FBI agents leaked to the press that he had been a target of a $50,000 bribery scheme in which he was caught on camera talking cash in a Cava fast casual restaurant from undercover FBI agents posing as potential government contractors. Pure corruption.

Homan's purpose now was to make contact with Governor Tim Walz and Mayor Frey and offer a pathway to "drawdown" ICE resources and "calm tensions." Both Walz and Frey, operating in good faith and with concern that they didn't want to see any more murders in the streets, held conversations with Homan. But one very strange disclosure occurred. Media outlets reported one of the negotiating terms offered by Homan was that if Minneosta turned over its voter rolls, the ICE drawdown take place with speed. We cannot be sure if this happened in a direct fashion or by elliptical implication. But the leak of this potential bargaining process suggests a grotesque reality: that the entire Operation Metro Surge was a violent assault on a state designed to make it cooperate with a criminal conspiracy to damage its election infrastructure.


Trump's behavior is not abstractly violative of the Constitution. Using a paramilitary operation to try to seize control of a state's elections is an egregious act of misconduct. This is not "High Crimes and Misdemeanors" which historical interpretation has basically rendered to mean "bad stuff" not technical crimes. This is not even the rather strange "emoluments" clause which involves gifts and bribes by foreign powers. These are big violatons. Let's look at just two of them.

The Guarantee Clause: Art. IV. Sec. 2, Cl. 4:

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.

The United States Constitution has a "Guarantee Clause." It guarantees to each State a small 'R' "republican form of government." What this means, Constitutional scholars debate and perhaps limit. But sending an invading force into Minnesota to get its voter rolls puts this clause into play.

In law school twenty-five years ago the Guarantee Clause was so sleepy it didn't even rate a mention. It theoretically might come up in the context of the Civil War and the insurrection of the southern States against the Union. Or it might be mentioned in the "Indian Wars" both before and ante- and post-bellum. But now, in light of what is happening in Minnesota, it's hard not to think Trump has put the Guarantee Clause in play by triggering chaos in the streets of an American city.

The Elections Clause: Art. 1 Sec. 4, Cl. 2:

The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of choosing Senators.

The Constitution makes crystal clear states manage and administer their elections unless the Congress passes a law. The President has no role in this process. The fact that this clause is in Article I, which pertains to the Legislative Branch, makes clear the Founders intended for elections to be administered by legislatures or Congress, the institutions most proximately chosen by the people. Not the Judiciary and not the Executive. Until Trump came along, no President in American history had so placed elections integrity in doubt. In fact, politicians made a point of underscoring their faith in elections by having a good humored exchange of pleasantries between the losing and winning contestants. Trump undermined this norm in 2016, but obliterated it in 2020.

Why did he want these rolls? Minnesota had told him no three times. Trump doesn't forget any slight. But for what he believed to be a mostly white nordic state in the Midwest, this was an unthinkable slight. It's one thing to have the lefty-loonies in Washington, Oregon, and California reject him. Or the Massachusetts hippies. But Minnesota was intolerable to him. Moreover, someone must have been whispering in his ear about the real reason he lost. Somalis.

II. Stephen Miller Uses Nick Shirley to Ignite a Reichstag Fire, An Economic War on Minnesota Preceding the Shock Troops

In the 1990s Somalia, the West African coastal nation near strategic transport routes, had fallen into a deep and painful civil war. Various warlords carved up the territory and fought devastating gangland battles among themselves. The United States feared the failed state would become a hotbed for Islamist terrorists. Already Somali piracy was putting sea lanes for commercial shipping under duress. President Clinton sent in the U.S. military to restore a semblance of order. The fierce and unrelenting urban combat became the topic for the book and movie Black Hawk Down.

The United States also made it possible for Somali refugees to apply for asylum and temporary protected status. Over many years Somalis settled in easy going, friendly cities like Houston and Minneapolis. It was a policy of U.S. refugee resettlement to try to bring people from one geographic region to one place so that they could rebuild a sense of community while integrating into the U.S. Today Somali-American Minnesotans are spread far and wide in the states' communities and contribute to all facets of society.


But you can't just fully invade a state. Even in this fraught and brittle moment. Invading over voter rolls is just plain crazy. And how do you invade Minnesota, one of America's most well-run, beloved and laconic places (outside of a Vikings game, maybe). For Miller, whispering into Trump's ear that Democratic Somalis overran this "white state" and corrupted the 2016, 2020, and 2024 elections. This hook gave Miller an easy route to convincing Trump he needed to come down hard on the state. But Miller has another motive. He doesn't care about the 2020 election. He wants to test his ethnic cleansing machine. It doesn't hurt that the state's governor, Tim Walz, had attacked Trump in 2024 in ways that would not be forgiven or forgotten.

Miller helped Trump fashion a key to pick the Minnesota lock. The answer would come from a half-witted oaf named Nick Shirley. Shirley was a "guerilla ratfucker." He was schooled in the James O'Keefe Project Veritas school of right-wing ambush arts. You find a "liberal" issue, choose a target to embody it, you accost them on the street or undercover at work. You then edit and splice the footage to make the target into whatever nefarious character you want them to be. Release the video into the wild and let the right-wing media machine take it from there. There was an added bonus in it for Trump, one that must have been irresistible. Miller could work with Fox News and the online right-wing networks to stand up a brutal attack on Governor Tim Walz as having been in charge of it. Take out my most despised white male rival? Do it.

In Decemeber 2025, Shirley set about filming himself going to various Somali daycares and business parks throughout the city. He posted himself outside their closed doors and generally harassed the daycare workers. He claimed his videos proved the daycares were fraudulent empty building. Shirley implied that he discovered a massive Somali fraud ring. "Big, if true" as the saying goes.

But Shirley didn't get this idea from thin air. Several years ago, a white Minnesotan named Aimee Bock masterminded a day care fraud, conspiring with several people to receive state funds by inflating daycare attendance and creating phantom early childcare centers. Brock was prosecuted along with many other by the U.S. attorney for the District of Minnesota. The fraud was real. But so was the accountability and convictions. Shirley just resurrected this fraud and claimed he had discovered it anew. Shirley is too stupid to have come up with this on his own. Rather, this whole operation has Miller's fingerprints all over it.

What was strange about Shirley's antics is how quickly they were picked up Trump's administration. Within literal days of his ambush videos going viral on right-wing social media platforms, they sprang into action. Pam Bondi, Trump's Attorney General announced she was opening investigations. Brook Rollins, Secretary of Agriculture, announced that she was suspending assistance payments for several large social assistance programs. Linda McMahon, a professional wrestling executive who was installed to destroy the Department of Education, announced she was suspending Title IX funding over transgendered athletes. Anyone who has familiarity with policy making circles knows that these type of announcements do not happen within a week out of nowhere.

The process continued even as Minnesota fell into deeper chaos. After the murder of Reneé Nicole Good, Kelly Loeffler, head of the Small Business Administration announced the termination of 6,000 loans and threatened to close the Minneapolis office due to instability. The speed and coordinated execution of these actions show a government that was readying itself to wage an economic war on Minnesota far before the sweeps. This was not a "off the cuff" set of decisions by Trump's cabinet. On the contrary, this has all the hallmarks of a planned effort. Miller had Trump's usual squad of merry tricksters work with Shirley to create the "Reichstag Fire" for Trump to send in his shock troops for the "immigration sweeps" to "root out the Somali fraud."

III. The Trump-Miller Deal: A War on Elections for a Test-Run of an Ethnic-Cleansing Machine

Trump and Miller could made a deal here. Trump could get his voter rolls from the blue states for his singular revenge campaign, while also trying to attack their election infrastructure before the November 2026 midterms. The president also could nurse his most fevered obsessions about the big lie: the stolen election of 2020. Trump hasn't spared a single day of thinking about that contest. The time when the entire nation declared him a loser. Miller, in exchange would get to trial balloon his race war and test his deportation and ethnic cleaning system.

Miller, who is Trump's Deputy Chief of Staff, is both a white supremacist and a white nationalist. His title is deliberately subordinate. A sometimes tactic in authoritarian regimes is for the real powerful people to have a seemingly innocuous title. It sounds as though he is insulated and overseen by many people. The term "Deputy" within his name has a disarming effect. But when things went sideways in Minneapolis, DHS Secretary Kristi Noem claimed that she, a cabinet-level secretary, reported to him. This bears repeating: The Secretary of the Department of Homeland Security said she reported to the Deputy Chief of Staff of the White House. The disturbing conclusion is that Miller is really in charge.

Miller's most consistent, deeply held belief, is his desire to create a whites-only ethnostate with a sub-class of Black and Indigenous people who will be servile to a white master race. I don't think Miller wants to repeal the Thirteenth Amendment, which outlawed slavery. But I think he wants to make it virtually irrelevant by materially returning Black and Indigenous groups to a status of controlled servility of the antebellum era. As for any Brown people, Miller hasn't really minced words. He wants them out of the county for polluting the blood of the white race. He regards them as subhuman, animalistic, disease-ridden, and unworthy of the protections of the Constitution, or even any "niceties" in being removed from American soil.

It's appalling but he hasn't hidden his views from us. Furthermore, Miller hasn't just planned to go after Somalis, which Trump had a deep personal animus toward since his sparring with U.S. Representative Ilhan Omar. He wanted to test run his ethnic cleansing campaign. Miller ordered the Operation Metro Surge secret police, mostly the rough and jack-booted CBP officers, to sweep the region of almost any foreign Brown or African person they could find. He wanted to see if he could get this secret police to sweep the city and get the kidnapped targets into concentration camps before Minnesota courts could react. If they did react, he wanted to see how. He wanted to see what the weak points were in his massive, factory-speed deportation machine which uses a mix of concentration camp prisons on federal property and private prisons like the GEO Group. He wanted to see how communities would react and determine how to adjust his tactics. Neither Miller, Noem, Bovino, Homan or Trump counted on the ferocity of the civil resistance.


As Operation Metro Surge unfolded, or more accurately unraveled, Trump absconded from the country. In Davos, Switzerland at the World Economic Forum, Trump gave a series of speeches and sideline meeting press conferences in which he talked incessantly about the stolen election of 2020. You could sense the defensiveness of his digressions. But why in the midst of an immigration surge is he so focused on the 2020 election? Because that's how Miller pitched the whole thing to him. You'll get the voter rolls and you'll find out about the Somali fraud.

Trump left Davos marginally humiliated about Greenland and had to furiously backpedal on hammering NATO at this meeting. Mark Carney gave a towering speech about the end of Pax Americana. Having been resoundingly rejected by Europeans and the media, I remarked at the time that Trump was going to come home from Davos like an abusive father coming back from a public dinner in which the family made light jokes about him. My exact remarks were: "Trump is going to come home and really beat the shit out of us." The table had been set for an escalation of violence in Minnesota in just the manner that it unfolded.

IV. All Trump's Criminal Conspiracies Meet in Minnesota

At the beginning of the month Special Prosecutor Jack Smith testified that there was sufficient evidence for prosecuting Trump over the insurrection he formented at the U.S. Capitol on January 6, 2021. But he also implicated Trump in the scandal to interfere with the certification of the Georgia election by trying to tamper with the lawful vote count. Finally, he also said there was sufficient information to prosecute Trump for stealing classified documents from the White House upon his exit. He portrayed Trump effectively as a gangster occupying the White House.

We have known he is a criminal, petty and grand. But we need to see the attack on Minnesota as bringing together the behavior of a mafia boss. The scholar Sarah Kendzior has said that she would characterize Trump as leading a "mafia state." This is an accurate frame of reference. Looking at his criminality in pieces obscures the true wide ranging nature of the treasonous conspiracy. This was one of Merrick Garland's failures. In the interest of bringing what he felt to be a tidy, airtight case, that a jury could act on, Garland's hyper focus made him lose sight of the whole scope of Trump's obvious gangsterism right before his eyes.

This was a criminal conspiracy to invade an American state. A total upstaging of the Constitution. Trump's invasion of Minnesota wasn't haphazard. It wasn't random. It was carefully planned at the highest levels. By Stephen Miller.

Importantly, Trump has been relentlessly focused on rigging the upcoming election. He has spent several late nights ranting about springing Tina Peters from state prison in Colorado. Peters was supervisor of elections in Mesa County, Colorado from 2019-2023. She was convicted and sentenced to nine years in prison for attempting to unlawfully seize voting machines under her supervision. Trump is so obsessed with Peters' case that he actually tanked a massively popular water bill championed by MAGA Congresswoman and right-wing extremist Lauren Boebert. He was incensed that Colorado Governor Jared Polis would not pardon and release Peters from prison. Trump was literally threatening to starve the state of water to get his election co-conspirator out of prison.

Trump's singular obsession with Peters' case is strange. That is until you remember how Trump treated Paul Manafort and Michal Flynn. Both went to prison rather than rat him out. Peters comes off a bit like Frank Pentangeli from Godfather Part II. One wonders if she could implicate Trump directly and is choosing to stay good and silent in the hopes that he can put his considerable weight on Polis to secure her pardon. The rewards would be her freedom and a seat on the scammy Trump Train, which would no doubt make her low-grade rich.

Trump also let DOGE cyberhackers steal data from the IRS and Social Security Administration and give it to voter fraud companies to search for "fraud." Elon Musk and Peter Thiel helped him set up those systems with other tech oligarchs, in exchange for big regulatory wins, closing cases, winning big government contracts and tax breaks and controlling AI and data surveillance. You know Trump wants run the voter roll data through these program and unleash a wave of voter fraud cases across the country in blue states. The goal is not necessarily convictions. The goal is terrorizing voters to make them fearful of participating in any elections. Trump wants people to be afraid to vote. He wants those who have dared to vote for Democrats to be afraid of the state coming after them. He wants to set back efforts of states to administer their elections by making a soup of their voter rolls.

Trump is attacking the process of postmarking ballots. For as long as anyone can remember the United States Postal Service followed "just in time" postmarking. The day you arrived at the post office, your item was stamped with the date. Now, the USPS is sending the mail to regional centers and the postmark can arrive days late. This seriously imperils the administation of elections nationwide when ballots have to be postmarked by election day to be counted. But it is extremely serious in Oregon and Washington State which use all mail in voting. It would effectively render their elections undoable. Both states are strenuously fighting back in court.

Trump had the FBI raid the elections offices of Fulton County, GA to seize 700 boxes of ballots from the 2020 election. This project was overseen by our current Director of National Intelligence, Tulsi Gabbard, an absolutely unthinkable act that no previous DNI would have ever engaged in. In effect, with these ballots in possession of Kash Patel's FBI, they have been irredeemably tampered with and are effectively spoiled. But Trump is going to claim that he has found greater than 11,780 instances of fraud meaning he won the state in 2020. He may then use this as a launching point for criminal charges of a raft of Biden-Harris administration officials.

Even Trump's kidnapping of Maduro has its ties to his election conspiracies. Right wing fever swamps alleged that Venezuela engaged in an effort to rig voting machines. Most of the non-MAGA public scoffed at such a ridiculous conspiracy. It's a bit of a chicken-egg situation. Did anti-Maduro forces try to bamboozle Trump into invading? Or did Trump invade to validate to force Maduro to participate in his electoral schemes? However, now that Nicolas Maduro has been kidnapped and is in US custody, one can only wonder if he will be willing to confess that he tried to interfere in the elections in support of Democrats. Why is it so ridiculous? He put the same pressures on Volodomyr Zelenskyy, demanding he concoct dirt on Joe Biden for the 2020 campaign in exchange for sending him life-saving defensive weapons. It was the source of one of his impeachment trials, right?

Conclusion

We are seeing Trump use Minnesota to scaffold up a massive criminal conspiracy to end free and fair elections in the United States of America. This is simply put the greatest act of treason in the nation's post Civil War history. His misconduct in Minnesota requires a phone-book sized articles of impeachment, numbering in the dozens, knitting together all these actions into one overarching indictment. While Democrats blanche at the idea of straying from a message of affordability and re-animating his base around his message of persecution, we have simply reached an intolerable point. History must carefully and cohesively explain how Trump and his administration have been plotting convoluted criminal conspiracies against our states to serve the cause of ending our democracy.

Democrats are scalded by January 6. Understandably so. It was a deeply terrifying time for them. Certainly some of them believed they were going to be executed by paramilitary maniacs storming the grounds. They see that Trump wasn't chased from politics, much less criminally charged. He grew even more virulent and stronger. They are scared of where we are and are not sure that speaking up about this wide-ranging massive criminal conspiracy centered on Minnesota is worth it. Can't we just talk about the kitchen table issues? I don't know about you, but Minnesota is the issue we talk about at our kitchen table.

Donald Trump has in Minnesota plotted to end our Constitutional republic by late 2026. He is amassing overseas bank accounts flush with cash just in case his gambit fails. He says that the new East Wing "ballroom" is bulletproof and droneproof, terms more consistent with a bunker. He has suggested he will now tear down the West Wing to "make it symmertrical". Trump seems to be focused on turning the White House into an impreganable fortress which he isn't leaving ever. Meanwhile, Stephen Miller is examining Minnesota not as a warning but as a test case for his ethnic cleansing apparatus. Minnesota is not the end, where we can deescalate. It is the proving ground for an all out attack on other states and our multiethnic society as a whole.

In short, Minnesota is everything.
